Raine & Horne Pottsville Beach/Cabarita Beach - HOLIDAY PREMISES TERMS AND CONDITIONS

You hereby agree to the following terms and conditions for Holiday Rental Accommodation.  Failure to adhere to these terms and conditions may permit the landlord or landlords’ agent, to refuse keys, amend the charge, or immediately terminate the occupancy of the holiday letting.

It is the holiday guests’ responsibility to read these terms and conditions thoroughly.  By booking a holiday property with Raine & Horne Pottsville Beach/Cabarita Beach you agree to the terms and conditions herein.

  1. PERIOD OF USE

The guest has the use of the property in accordance with these terms and conditions from 12.00pm to 9.00am (DST) during the period as stated on the receipt.  Check-in time is 12.00pm on the first day of the period and Check-out time is 9.00am on the last day of the period on the receipt of payment.  Keys must be picked up from and returned to our office – 3 Coronation Ave, Pottsville, NSW.

Please note that this office works on Daylight saving time (DST).  If you are unable to arrive during business hours to collect your keys, it is your responsibility to contact the office to arrange collection of keys after hours.  This must be arranged 24 hours prior to your arrival.  The agent shall not be responsible for alternative accommodation, or any other costs, when the tenants arrive after hours. Office hours are as follows:

  1. RENTAL CONTRACT

The short-term accommodation contract is between the Guests and the Owner of the individual property and is subject to the terms and conditions herein.  The contract for accommodation shall not be effective until the Owner or the Owners Agent sends the guest confirmation of the booking.  A booking request is not deemed to be a booking.

  1. PAYMENT

All Payments are to be made in full prior to occupancy or keys will NOT be available for collection and access will be refused.

3.1  DEPOSIT

A 50% deposit of the total amount is due within 10 days of making the booking.  This amount is made up of 50% of the rental amount for the period, a booking fee, security bond and any additional service fees such as pet tariff or additional amenities.  The accommodation booking will not be confirmed by the Owner or Agent until the Guests’ deposit payment is received and cleared.

  1. 2 BOOKING FEE

Raine & Horne Pottsville Beach/Cabarita Beach charge a booking fee of $40.00 per booking.  If you are using a third party website (e.g. STAYZ) the third party may also charge a booking fee for services provided.  Please refer to their terms and conditions in regard to this amount.

NB:  If you book directly with our office or via our company website no third party booking fee is applicable.

  1. 3 SCURITY BOND

A security bond for each booking is required.  The amount of the bond varies according to the property booked.  Please refer to the property details for this amount.

The bond will be refunded subject to an inspection of the property, no breach of the terms and conditions and the property being returned in the same condition as at the commencement of the booking.  

The refund will be way of direct deposit into your nominated bank account within 7 – 10 business days of your departure.  Please provide these details prior to your departure.  Should you be unable to provide bank account details, with prior arrangement, a cheque can be posted to your address shown on the booking.  NB:  A $20.00 charge is applicable to re-issue a cheque due to loss, damage or name change. Bank account details must be provided via email, hand written details will not be accepted under any circumstances due to likelihood of error.

  1. 4 BALANCE DUE/FINAL PAYMENT

The full amount payable in respect of the Property booking must be paid 3 weeks preceding the commencement of the booking.  If the full payment has not been received by the Owner/Agent at least three weeks prior to the start of the booking period, then the Owner/Agent reserves the right to cancel the booking without notice.  The guest will forfeit the deposit which will be non-refundable in such circumstances.  The Guests will be responsible for payment of the full rental amount whether or not occupation of the Property occurs.

  1. 5 PAYMENT METHOD

Payment is able to be made by direct deposit, or cheque into the following account:

 If bookings are made for immediate occupation a cash only payment will be required. 

  1. 6 BOOKING CONFIRMATION

Once a Guest’s booking has been confirmed, the Guest shall be responsible for payment of the total price for the rental period and all extras (if any) as shown on the confirmation notice.

  1. CANCELATION POLICY

In the event of a cancelled booking by the guest, all monies paid are non-refundable unless the premises can be re-booked for the entire period, in which case a cancellation fee of 10% of the total amount will be deducted from the deposit.  A minimum fee of $35.00 will apply.

  1. DESCRIPTION OF THE PROPERTY

All information in respect of the Property contained in the Owner’s/Agents promotional material is believed to be correct at the time of printing however, all details contained in the material are subject to change by the owner without notice.  The Owner/Agent will not accept any responsibility for any alterations to the Property or any part thereof beyond the Owners’ control or any liability for any damage caused by extreme weather conditions, break-down of appliances or motor vehicles, wiring, plumbing, invasion of pests or any act or omission on the part of the Owner causing loss, accident or injury to the Guest or any one or more of them.

  1. ADVERTISED PRICES

Holiday booking prices vary according to seasons, holidays, special events, changing market conditions.  Prices stated by the Owner/Agent are subject to change at any time without notice, prior to confirmation of the booking.

  1.  AVAILABILITY OF THE PROPERTY
    1. 1 The short term accommodation contract negotiated by the Owner/Agent and made between the Guests and the owner is made on the understanding that the Property and its facilities as stated in the booking confirmation will be available as represented to the Guest.  Should any events whatsoever arise beyond the reasonable control of the Owner which render the Property uninhabitable (for example: flood, fire, storm, tempest, etc.) then the Owner may have to cancel the Guest’s booking for the Property.  The Owner will refund all monies paid by the Guest in respect of the Property.  Upon refund of the monies paid, the guest shall have no further claims whatsoever against the Owner.
  1. 2 In the event of the property being on the sales market the occupier agrees to allow the owner, or his agent, to inspect the property with prospective purchasers during reasonable hours by appointment.
  1. 3 The agent cannot be held responsible if the property is sold, or withdrawn from the holiday market, and the booking is cancelled.  All endeavours to find alternative accommodation shall be made by the agent.
  1. 4 The booking is made in good faith by Raine & Horne Pottsville Beach/Cabarita Beach, but may be subject to any change as may be notified by the owner prior to commencement of the booking.  The agent accepts no liability where any changes to bookings are made by the owner.
  1. 5 The owner/agent reserves the right to revoke or refuse to honour any property accommodation booking which may in the opinion of the owner/agent (and at his sole discretion) be unsuitable.
  1. RESIDENTIAL TENANCIES ACT NOT APPLICABLE

The Guest and the Owner acknowledge and agree that the Agreement to which these conditions apply is  bona fide entered into for purposes of conferring on a the Guest a right to occupy premises for a holiday only for term that does not exceed 59 days.

  1. GUESTS OBLIGATIONS AND CONDITION OF ENTRY AND USE
    1. 1Only guests listed on the guest register are to be accommodated at the property.
  1. 2 The property is NOT to be used for weddings, parties, hens/bucks nights, receptions, performances, filming, photography shoots or commercial purposes.  Should the guest use the property for these purposes, their right to occupy the property will cease immediately and the entire bond will be forfeited to the owner.  No refund of unused rental fees will be given.
  1. 3 Please note that Pottsville is a residential area.  Please minimise any disturbance to neighbours.  Should the agent/owner receive any noise/nuisance complaints by adjoining or neighbouring occupiers, the agent reserves the right to seek vacant possession immediately and the guest will forfeit their full bond, any rental fee paid plus any additional costs incurred.
  1. 4 ALL HOLIDAY PREMISES ARE SMOKE FREE ENVIRONMENTS.  Should the guest smoke cigarettes, tobacco or any form of product either legal/illegal inside the home, the entire bond will be forfeited.
  1. 5 PETS

Pets are strictly NOT PERMITTED on properties unless advertised as “Pet Friendly” and the owner/agent have expressly permitted the pet to be kept at the premises.  In the instance where a pet HAS been permitted, an additional fee is charged.  This additional fee is payable to the owner and non-refundable.  It is the guest’s responsibility to ensure they clean up after their pet.

  1. 6 PARTY SIZE

The applicant/guest may only allow the Property to be occupied by a maximum to that of which the property is advertised.  Bedding will be provided for the maximum number of guests.  Under no circumstances shall the number of people occupying the Property be greater than the maximum without the Owners/Agents written permission.  Guests remain responsible for visitors attending the property.  The Owner/agent reserves the right to refuse occupation of the Property to the Guest or cut short the stay of the guest and retain the entire bond if the condition on the number of people intended to occupy the Property is not reserved.
